Terms of Use
These Terms of Use ("Terms") govern your access to and use of PriscillaKing.com (the "Site"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Who operates this Site
The Site is operated by Priscilla King, a licensed real estate salesperson in Texas and Montana. Brokerage services are provided through the sponsoring brokerage licensed in the state where the property is located:
- Texas — Sales Agent, License No. 847991, sponsored by Mallach and Company, License No. 9001091.
- Montana — Salesperson, License No. RRE-RBS-LIC-136719, supervised by Broker Joy Vance at The Agency Bozeman | Big Sky, 346 Central Avenue, Whitefish, Montana 59937
This Site is not a real estate brokerage and Priscilla King does not operate an independent brokerage. All real estate services described on this Site are offered through and supervised by the applicable sponsoring brokerage named above. We are licensed to provide real estate brokerage services only in Texas and Montana, and nothing on this Site is an offer to provide brokerage services in any other state.
2. No brokerage or agency relationship is created by using this Site
Using the Site, submitting a form, subscribing to updates, or exchanging emails or text messages with us does not create an agency, brokerage, fiduciary, or client relationship. A representation relationship is created only by a written agreement signed by you and the applicable sponsoring brokerage.
Texas consumers: please review the Texas Real Estate Commission Information About Brokerage Services notice and the Texas Real Estate Commission Consumer Protection Notice, both linked in the footer of every page of this Site.
Montana consumers: Montana law requires that you receive the statutory brokerage relationship disclosure before we provide brokerage services to you. Ask us for it, and we will provide it at or before the first substantive contact regarding a specific property.
3. Property information is not guaranteed
Property listings, square footage, lot dimensions, zoning and land use designations, utilities, traffic counts, demographics, rent rolls, expense figures, tax amounts, permitted uses, and similar information are obtained from sources including multiple listing services, commercial listing platforms, owners, county appraisal districts and assessors, and third-party data vendors.
We believe this information to be reliable but we do not warrant or guarantee its accuracy or completeness. All information is subject to errors, omissions, change in price, prior sale, lease, or withdrawal without notice. You are responsible for independently verifying every material fact through your own inspection, survey, engineering, environmental, zoning, and legal review before relying on it.
4. Market analysis and investment content is educational only
The Site publishes market commentary, corridor and submarket analysis, cap rate discussion, pro forma illustrations, absorption and traffic data, blog articles, and video content. This material is provided for general informational and educational purposes only.
Nothing on this Site is investment, tax, accounting, legal, engineering, environmental, appraisal, or lending advice, and nothing on this Site should be relied upon as a recommendation to buy, sell, lease, finance, or hold any property or interest in any property. Priscilla King is a licensed real estate salesperson, not a licensed appraiser, attorney, certified public accountant, investment adviser, or broker-dealer.
Any projection, pro forma, cap rate, return figure, absorption estimate, or forward-looking statement reflects assumptions that may prove incorrect. Past performance and current market conditions do not predict future results, and no return is promised or guaranteed. Consult your own attorney, CPA, and financial advisors before making any real estate decision.
5. Intellectual property
Unless otherwise noted, all content on the Site — including photography, aerial and drone imagery, video, brand elements, page copy, blog articles, market reports, site plans, graphics, and layout — is owned by Priscilla King or used under license, and is protected by United States copyright and trademark law.
You may view, download, and print Site content for your own personal, non-commercial use. You may not copy, reproduce, republish, distribute, scrape, frame, mirror, sell, license, or create derivative works from Site content, or use it to train any machine learning or artificial intelligence model, without our prior written permission.
Listing content supplied by an MLS or commercial listing platform remains the property of that source and is subject to that source's terms of use and attribution requirements.
"REALTOR®" is a registered collective membership mark of the National Association of REALTORS®. "Mallach and Company," "The Agency," and related marks are the property of their respective owners and are used with permission of the applicable brokerage.
6. Your submissions and communications
By submitting a form, comment, review, testimonial, photograph, or other material to us, you represent that you own it or have the right to provide it, and you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display it in connection with our marketing, subject to our Privacy Policy. Do not submit confidential information, personal financial documents, or anything you are not authorized to share.
By providing your email address or telephone number, you consent to receive communications from us at that address or number regarding your inquiry. Marketing communication preferences and opt-out instructions are described in our Privacy Policy. Consent to receive marketing messages is not a condition of any purchase, sale, or lease.
7. Acceptable use
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms.
- Scrape, harvest, or use automated means to collect data from the Site without written permission.
- Attempt to gain unauthorized access to the Site, its servers, or related systems.
- Introduce malware, or interfere with the Site's operation or security.
- Submit false, misleading, or fraudulent information, or impersonate any person or entity.
- Use the Site or its content in any manner that violates fair housing or anti-discrimination law.
8. Third-party links and embedded services
The Site links to and embeds third-party services, including IDX and MLS search tools, commercial listing platforms, mapping, video players, calculators, scheduling tools, and social media. We do not control those services, do not endorse their content, and are not responsible for their availability, accuracy, or practices. Your use of them is governed by their own terms and privacy policies.
9. Fair housing
We conduct business in accordance with the federal Fair Housing Act, the Texas Fair Housing Act, and the Montana Human Rights Act. See our Fair Housing Statement for details.

11. Copyright complaints (DMCA)
If you believe content on the Site infringes your copyright, send a written notice to our designated agent at privacy@priscillaking.com including: your contact information; identification of the copyrighted work; identification of the material you claim is infringing and its location on the Site; a statement that you have a good faith belief the use is not authorized; a statement under penalty of perjury that the information is accurate and you are authorized to act; and your physical or electronic signature.
12. Disclaimer of warranties
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECT WILL BE CORRECTED.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRISCILLA KING AND HER SPONSORING BROKERAGES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST BUSINESS OPPORTUNITY, OR LOST DATA, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).
Nothing in these Terms limits any liability that cannot be limited under applicable law, and nothing in these Terms limits obligations arising under a separate signed written representation agreement or under Texas or Montana real estate licensing law.
14. Indemnification
You agree to indemnify and hold harmless Priscilla King and her sponsoring brokerages from any claim, loss, liability, or expense, including reasonable attorneys' fees, arising out of your use of the Site, your violation of these Terms, or your violation of any law or third-party right.
15. Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules, and you agree to the exclusive jurisdiction and venue of the state and federal courts located in Travis County, Texas, for any dispute arising out of your use of the Site.
This provision applies to your use of the Site only. Real estate transactions are governed by the law of the state where the property is located — Texas law for Texas properties, Montana law for Montana properties — and by the terms of any separate written agreement you sign with the applicable sponsoring brokerage.
16. Changes to these Terms
We may revise these Terms at any time. The "Last updated" date above reflects the most recent revision, and changes take effect when posted. Your continued use of the Site after a change means you accept the revised Terms.
17. Severability and entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding your use of the Site.
